1. Parties and definitions
1.1 This agreement is between you and [ISSUER NAME] ("Issuer"), authorised by [REGULATOR] under reference [LICENCE NUMBER], with registered office at [ISSUER ADDRESS]. The card is issued pursuant to a licence from [CARD NETWORK]. Fundly, a trading name of [LEGAL ENTITY NAME], distributes the card and operates the platform on the Issuer's behalf.
1.2 In this agreement:
- "Card" means a virtual or physical prepaid card issued to you under this agreement.
- "Account" means the balance held for you with [EMI PARTNER NAME] or, for Instant cards, the e-money balance held with the Issuer.
- "Platform" means the Fundly web application and any mobile applications we may release.
- "Instant card" means a Card issued after light verification, subject to the limits in section 5.
- "Verified card" means a Card issued after full identity verification.
- "Plan" means the Free, Plus or Premium subscription you have chosen.
2. Issuing the Card
2.1 The Issuer may issue you a Card once you have met the eligibility checks in the Fundly Terms of Service and this agreement. The Issuer may decline to issue a Card without giving reasons where the law allows.
2.2 The Card is a prepaid card. It is not a credit card, and it is not linked to a bank account with the Issuer. You can only spend the balance you hold.
2.3 The Card remains the property of the Issuer. You must return or destroy it if asked.
3. Virtual and physical cards
3.1 A virtual Card is delivered on the Platform. You can view the card number, expiry and security code on the Platform after authenticating.
3.2 A physical Card is available on the Verified tier. It is posted to the address you have verified. Delivery times and the countries we ship to are shown at /cards/physical. A fee may apply under the Fee Schedule.
3.3 Plus and Premium plans allow you to hold more than one virtual Card. Each Card shares the same Account balance unless you set a card limit.
3.4 A Card expires on the date shown on it. We will issue a replacement before expiry if your Account is in good standing.
4. Activation, Apple Pay and Google Pay
4.1 A virtual Card is active when issued. A physical Card must be activated on the Platform before use.
4.2 Where available, you can add your Card to Apple Pay, Google Pay or other digital wallets. Wallet availability depends on your country and device and is subject to the wallet provider's terms. We will tell you on the Platform whether wallets are available for your Card.
5. Limits
5.1 Every Card has limits. Limits are set by the Issuer, by [CARD NETWORK] and by regulation, and can change. Current limits are always shown on the Platform.
5.2 Instant card. Monthly load limit of approximately [PROVIDER LIMIT] EUR equivalent (expected range 1,000 to 2,500 EUR). Single transaction limit of approximately [PROVIDER LIMIT] EUR (expected 500 EUR). No ATM withdrawals, or a low ATM limit of [PROVIDER LIMIT] where offered. No physical Card and no IBAN.
5.3 Verified card. Monthly load limit of up to [PROVIDER LIMIT] EUR (expected 50,000 EUR), which may be raised on review. Single transaction limits follow [CARD NETWORK] scheme limits. ATM withdrawals within the allowance of your Plan.
5.4 You can set your own lower limits on the Platform. Your own limits never raise the Issuer's limits.
6. Using the Card
6.1 You may use the Card anywhere [CARD NETWORK] cards are accepted, online and in person, subject to any merchant category restrictions shown on the Platform.
6.2 A transaction is authorised when you tap, insert, enter your card details online, or confirm in a digital wallet. Once authorised, a transaction cannot be cancelled by you.
6.3 You must not use the Card for anything unlawful, for gambling where prohibited, or for business purposes.
6.4 Some merchants, such as hotels and car rental companies, pre-authorise an amount higher than the final bill. The held amount is released when the merchant settles, usually within 7 days but sometimes up to 30.
7. Currency conversion
7.1 Your Account is held in EUR (or USD where offered). When you pay in another currency, the amount is converted at the rate shown on the Platform before you confirm, or at the [CARD NETWORK] rate on the day of settlement for offline and pre-authorised transactions.
7.2 The FX fee for your Plan is added to the conversion: 1.5% on Free, 0.5% on Plus, 0% on Premium. The fee and the rate are shown on the transaction on the Platform and on your statement.
7.3 If a merchant offers to convert the amount into your currency at the terminal (dynamic currency conversion), that conversion is done by the merchant at their rate. We recommend paying in the local currency.
8. Declined transactions
8.1 A transaction may be declined if it exceeds your limits, if your balance is insufficient, if the Card is frozen, if the merchant category is blocked, if our fraud systems flag it, or if the law requires it. We will tell you the reason on the Platform where we are allowed to.
9. ATM withdrawals
9.1 ATM withdrawals are available on Verified cards within the allowance of your Plan. Fees are set out in the Fee Schedule. ATM operators may charge their own fee, which we do not control.
10. Keeping the Card safe
10.1 You must keep your card details, PIN, passcode and two-factor codes secret, and keep your device secure.
10.2 If your Card is lost, stolen, or you think someone else knows the details, freeze it on the Platform immediately and contact us at support@fundly.xyz or through the Platform. You can unfreeze a Card you find again.
11. Liability for unauthorised transactions
11.1 If a transaction was not authorised by you, tell us without delay and in any case within 13 months. We will refund the amount by the end of the next business day unless we have reasonable grounds to suspect fraud on your part.
11.2 You may be liable for up to [STATUTORY CAP] of losses from unauthorised transactions made before you told us, where the loss resulted from a lost or stolen Card or from you failing to keep the details safe. You are liable for all losses if you acted fraudulently or with gross negligence.
11.3 You are not liable for losses that occur after you have told us, unless you acted fraudulently.
12. Disputes and chargebacks
12.1 If goods or services you paid for were not delivered, were faulty, or the amount charged was wrong, contact the merchant first. If that does not resolve it, raise a dispute on the Platform within 120 days of the transaction. We will raise a chargeback with [CARD NETWORK] where the scheme rules allow. Chargebacks can take up to 90 days.
13. Fees
13.1 Card fees, including physical card issuance, replacement, FX and ATM fees, are in the Fee Schedule at /legal/fees. Fees are deducted from your Account balance.
14. Ending this agreement
14.1 You can cancel your Card at any time on the Platform. Any balance stays in your Account, and you can withdraw it under the Fundly Terms of Service.
14.2 The Issuer may suspend or cancel your Card immediately if you breach this agreement, if the Issuer suspects fraud or unlawful use, if required by law or by [CARD NETWORK], or if the Fundly programme ends. Otherwise the Issuer will give you 2 months' notice.
15. Complaints
15.1 Contact Fundly first at support@fundly.xyz. If you are not satisfied after 15 business days, you may refer your complaint to the Issuer at [ISSUER COMPLAINTS EMAIL] and then to [OMBUDSMAN / DISPUTE RESOLUTION BODY].
16. General
16.1 This agreement is governed by [GOVERNING LAW]. The courts of [COURTS] have jurisdiction, without affecting your mandatory consumer rights. The Issuer may change this agreement with 2 months' notice, or without notice where the change is required by law or benefits you.
